With its first four trials involving alleged labor market abuse ending in acquittals, the Antitrust Division faces a growing chorus of skeptics. The Antitrust Division’s recent struggles at trial, however, are not unprecedented in the United States Department of Justice’s (“DOJ”) long history of trying complex criminal cases. As explained in this article, the challenges that the Antitrust Division faces in prosecuting labor-related conspiracies resemble challenges that DOJ prosecutors overcame in insider trading and market manipulation prosecutions over the last decade.
