For Richer or Poorer: The Defense of Marriage Act’s Waning Legitimacy in Bankruptcy Court

Cardozo Journal of Equal Rights and Social Justice

December 2012

Quote from article: “Equal access to bankruptcy remedies is unlikely to become the rallying cry for those in this country who believe that gays and lesbians should be permitted to make the same vows of commitment as their heterosexual peers. However, same-sex couples who vow to stick together "for richer or poorer" should be entitled to an even playing field vis-à-vis their heterosexual counterparts, particularly in times of financial distress. The doctrine of desuetude, although long absent from American jurisprudence, is uniquely equipped to provide this degree of equality.”
